Microsoft Would Comply With Marsha Pechman

The court ruled on the Vista Capable class action suit that requires Microsoft CEO Steve Ballmer to testify in court despite the efforts by Microsoft lawyers to keep him from appearing.

After some resistance from Microsoft, they have given in as Microsoft's spokesman have confirmed. In his statement:

"Mr. Ballmer’s knowledge about the Windows Vista Capable program comes from the executives he empowered to run the program and make decisions, and two of those executives already testified in this case."

Nonetheless, the judge was considerate of Steve Ballmer as the ruling only requires him for a three hour appearance duration within 30 days on a time convenient to him.

It would be interesting to see the development of the case as Steve takes the stand. But on the other hand, knowing how smart and intelligent Steve is, Microsoft might actually look good on the case.

The case is referred to as Kelley v. Microsoft Corp., 07cv475, U.S. District Court, Western District of Washington (Seattle).
